- The Fair Competitive Conditions Act transposes the UTP Directive into Austrian law. Austria partially goes beyond the EU minimum protection for suppliers and introduces stricter rules.
- The aim of the Act is to redress a possible imbalance between suppliers of agricultural and food products and buyers that have greater turnover.
- Violations can nullify the respective clauses and give rise to injunctive relief. Starting 01 May 2022, fines of up to EUR 500,000 can be imposed.
- Most of the provisions entered into force on 01 January 2022. Old contracts must be adapted to the new legal situation by 01 May 2022.
